摘要党的十九大报告将"依法立法"与"科学立法、民主立法"相提并论,是"依法立法"新理念在立法活动中的体现,反映了全面依法治国的深入推进对立法活动的新需求、新要求。"依法立法"作为新理念,具有理论基础和实践基础,在全面依法治国方略中有着重要的地位和作用。在新时代,科学立法、民主立法、依法立法有着各自的制度需求和发展走向。推进依法立法,需要坚持和完善党领导立法的相关制度、需完善立法主体权限和程序的制度设计、需以人民为中心完善法律的立改废释制度、需统筹立法引领与立法监督的制度设计。在此基础上,新时代推进地方依法立法要发挥中央和地方两个积极性,即提供中央立法"顶层设计"上的制度供给,以及发挥地方立法积极性并提供有效制度供给,同时,要加强对地方立法备案审查的监督以及加强对地方生态环境保护立法之制度约束。 The 19th National Congress of the Communist Party of China puts lawbased legislation on a par with legislation in a scientific and democratic way, which is a reflection of the new concept of lawbased legislation in legislative activities, showing the new demands and new requirements for legislative activities by the deepened lawbased governance in allround aspects. The lawbased legislation, as a new concept, has its theoretical and practical foundation and enjoys important status and role in the strategy of lawbased governance in allround aspects. In the new era, scientific legislation, democratic legislation and lawbased legislation have their respective institutional requirements and development trend. To promote the lawbased legislation, it is necessary to stick to and improve relevant systems on partyled legislation, improve the system design on the power of legislative subjects and legislative procedure, improve systems on enactment, amendment, abolishment and interpretation of law by focusing on the people, plan the systems on legislative leading and supervision as a whole. On basis of this, to promote the lawbased local legislation in the new era, it is necessary to bring into full play the initiative both at the central and local level, that is, offering institutional supply of toplevel design of legislation at the central level and bringing local legislative initiative into full play and providing effective institutional supply, and to strengthen supervision over filing and review of local legislation and to enhance institutional restraint over local legislation on ecoenvironment protection. 
