摘要
立法价值为学位立法工作的开展明确价值遵循,属于立法推进中的核心范畴。立法价值对于《学位法》的制定具有重要的价值意义,引导《学位法》确立科学合理的立法理念,并且推动着教育法制体系的不断健全,同时为学位制度的具体设计提供方向性指引。我国学位立法在价值层面上经历了一定的发展变迁,具体体现在三个维度:一是从工具价值到人本价值;二是从社会价值到个人价值;三是从管理价值到教育价值。针对当下我国制定《学位法》的价值定位来看,在应然层面,应当以对学术自由权与受教育权的保障作为基本价值遵循。在实践层面,应当在《学位法》的具体章节中,将对学术自由权与受教育权的保障明确化、具体化。
The legislative value is the core category in the promotion of legislation.The legislative value is of great significance to the formulation of the Degree Law because it guides the Degree Law to establish a scientific and reasonable legislative concept,promotes the continuous improvement of the legal system of education,and provides directional guidance for the specific design of the degree system.China’s degree legislation has undergone certain development and changes at the value level,which is reflected in three dimensions:firstly,from instrumental value to human-oriented value;secondly,from social value to personal value;and thirdly,from management value to educational value.With regard to the value orientation of the degree law in China,at the natural level,the protection of academic freedom and the right to education should be taken as the basic value.At the practical level,the protection of academic freedom and the right to education should be made clear and concrete in the specific chapters of the Degree Law.
