摘要
法律制度是环境治理的有效途径之一。河北省环境治理的立法经历了从无到有,从粗浅到提高的发展路径,在与上位法的衔接等方面有特色、有成绩,也存在立法主体权限不清、法律制度缺失、滞后等问题。因此,借鉴国外立法之经验,结合我国及河北省立法实践的需要,河北省环境治理立法上,要在立法主体层级化、法律制度体系化、法律保护全程化几个方面,建构更加完美的、健康的立法框架。
Legal system is one of the effective ways of environmental management. The legislation of environmental management in Hebei Province has gone through the development path from nonexistence to existence and from simplify to advancement.There are characteristics and achievements in the connection with the upper level law. There are also problems such as the unclear rights of the legislative body,the lack of legal system,and the lag of the legal system. Therefore,on the basis of the experience of foreign legislation and combining the needs of the legislative practice of China and Hebei Province we need to build a more perfect and healthy legislative framework in the aspects of legislative body hierarchy,systematic of legal system and whole process of law protection in the legislation of environmental management in Hebei Province.
