摘要
《立法法》自2000年颁布至今已有20余年。在过去20多年中,我国的立法体制伴随着改革进程不断完善,其间还经过了2015年《立法法》修改,通过基本法律来规范立法活动的意图日益明显。与此同时,立法学研究逐渐聚焦《立法法》并关注对该法进行规范释义,这种视角在未来立法学研究中将更为显著。与传统立法学研究更多偏向立法对策或建议不同,立法法释义学主要阐释《立法法》条文的规范内涵,从而明确立法规则和界限,最终发挥约束和控制立法活动的作用。在《立法法》进入下一个20年的起点,有必要明确提出立法法释义学、立法法教义学或立法法学的概念。立法法学主要采取释义学方法,基于《宪法》解释《立法法》,致力于发展系统、融贯和动态的立法规则体系。
It has been 20 years since the enactment of the Law on Legislation.Over the past 20 years,China’s legislative system has been continuously improved with the reform process,and the Law on Legislation was revised in 2015.The intention of regulating legislative activities through basic laws has become increasingly obvious.At the same time,legislative research has gradually shifted the focus to the Law on Legislation and paid close attention to the normative interpretation of this law.This perspective will be more prominent in future legislative research.Different from traditional legislative research which is more inclined to legislative countermeasures or suggestions,the legal dogmatics on legislation mainly interpret the normative connotation of the law on legislation,so as to clarify the legislative rules and boundaries,and finally play the function of restricting and controlling legislative activities.At the beginning of the next 20 years,it is necessary to clearly put forward the concept of legal dogmatics on legislation.The legal dogmatics on legislation should mainly adopt the means of legal interpretation,interpret the Law on Legislation based on the Constitution,and strive to develop a systematic,coherent and dynamic legislative rule system.
