摘要
2018年通过的宪法修正案在宪法第一条第二款增加规定“中国共产党领导是中国特色社会主义最本质的特征”,实现了党的领导由政治原则向宪法规范的转化,形成了我国现行宪法的中国特色社会主义最本质特征条款。这一条款既是中国特色社会主义发展的必然,也是我国宪法不断完善的必然。它不仅增强了宪法文本的逻辑连贯性,使宪法中“社会主义”概念更加明确和丰富,使“党的领导”更具有规范性,而且使其所处的宪法第一条第二款形成具有完整的逻辑结构、明确的规范内涵和规范效力的宪法规范,将赋予中国共产党不断加强自身建设以引领社会主义制度不断发展完善的义务,同时也为该条款的实施指明具体路径。
The constitutional amendment adopted in 2018 added"the leadership of the Communist Party of China is the most essential attribute of socialism with Chinese characteristics"to the second paragraph of Article 1 in the 1982 constitution of China,which transforms the political principle of party's leadership into a constitutional norm and results in the clause on the most essential attribute of socialism with Chinese characteristics in the 1982 constitution of China.This clause arises from the inevitable developments of the socialism with Chinese characteristics and the necessary improvements of the 1982 constitution of China.It enhances the logical coherence of the constitutional text,clarifies and enriches the concept of"socialism"in the constitution,and makes the"the leadership of the CPC"more normative.Moreover,it logically completes the second paragraph of Article 1 as a constitutional norm in structure,with clear normative connotation and normative effective.The CPC then will shoulder the obligation to strengthen and improve Party building in order to promote the continuous developments and perfections of the socialist system,which also indicates the future path to implement this clause.
