摘要
以浙江省18起法院判决的跨境电信网络诈骗犯罪案件为研究对象,根据法院的判决书采集犯罪数据,对涉及诈骗的犯罪行为人属性、诈骗组织结构、作案手段、犯罪产业链条进行案例剖析,对犯罪能力、犯罪收益、刑事处罚等维度指标进行统计分析,笔者发现跨境电信网络诈骗犯罪是有组织犯罪;同时,这也不是一种简单的低风险、高收益的犯罪类型,对于不同级别的罪犯来说,具有不同的犯罪收益和犯罪风险。应当采取"重典治乱"的刑罚策略,推进全球犯罪治理模式的国际警务执法合作,实施地域性职业犯罪预防和受害精准预防、系统性源头性全链条打击、统筹境内境外两个战场的"打防结合、预防为先"侦防策略。
Taking 18 cases of cross-border telecom network fraud in Zhejiang Province as the object,collecting criminal data according to the judgment of the court,analyzing the criminal attributes of the perpetrators involved in the fraud,the structure of the fraud organization,the means of committing the crime,the chain of criminal industry,and making a statistical analysis of the indicators of criminal capacity,the proceeds of crime,the criminal punishment and so on,it is found that the crime of cross-border telecom network fraud is an organized crime;at the same time,it is not a simple type of crime with low risk and high income,which has different criminal proceeds and criminal risks for different levels of criminals;Then it puts forward the severe penalty strategy to control chaos caused by this crime;the cooperation strategy of international enforcement policing of promoting the global crime management model;the implementation of regional professional crime prevention and precision prevention of the victim,striking of systematic and source of the whole chain of black industrial,and the strategy of the two battlefields on prevention and cracking down this crime of co-ordinate the domestic and overseas.
