摘要
在中国,仲裁基于非对称优势和替代诉讼的现实需求获得了快速发展,但虚假仲裁的现象也不时发生。虚假仲裁违反了诚实信用原则,妨害了仲裁秩序,侵害了案外第三人利益。在仲裁程序内部缺乏规制虚假仲裁的途径,必须依靠司法的强力介入。虚假仲裁司法规制可从救济与制裁之二元路径加以展开。救济对象是第三人,具体举措包括赋予第三人申请撤销仲裁裁决的资格、将仲裁调解书纳入司法审查的范围、合并针对国内仲裁裁决的审查方式、取消申请不予执行制度。制裁的对象是虚假仲裁行为人,具体举措包括行政处罚的适用以及刑事制裁。延展适用虚假诉讼罪不足以遏制虚假仲裁行为,有必要单独设立虚假仲裁罪。
In China,arbitration has developed rapidly because of its asymmetric advantages and the practical needs of alternative litigation.However,the false arbitration which violates of the principle of good faith,hinders the order of arbitration and infringes the interests of the third party also occurs occasionally.There is no way to regulate the false arbitration in the arbitration procedure,so we must rely on the strong judicial intervention.The judicial regulation of false arbitration can be carried out from the dual path of relief and sanction.The object of relief is the third party.The specific measures include giving the third party the qualification to apply for cancellation of the arbitration award,bringing the arbitration mediation into the scope of judicial review,and combine the review methods of domestic arbitration awards,and cancel the system of non-enforcement of application.The object of sanction is the actor of false arbitration.The concrete measures include the application of administrative penalty and criminal sanction.The extension of the application of the crime of false litigation is not enough curb the false arbitration.It is necessary to establish a separate crime of false arbitration.
