摘要
突发重大公共卫生事件后,为防控重大疫情的迅速扩散,安抚公众的恐慌情绪,政府部门披露涉疫人员信息的举措陆续在全国各地普遍实施,取得了较好的群防群治效果。披露涉疫人员信息具有正当性,这种正当性来源于理论支撑、现实需要和社会认同。但是,重大疫情防控不能因公共安全保障而全面放弃公民隐私保护,仍然需要遵循正当性标准要求的必要性、合法性、实效性三个维度进行评判,确保涉疫人员信息披露符合宪法和法律规定并能控制在最小范围。为防范涉疫人员信息被过度披露,就必须正视政府信息公开与个人信息保护等制度的不足,优化立法规制、行政规制、司法规制,促进公共安全保障与个人信息保护的平衡。
In order to prevent and control the rapid spread of major epidemics,and to calm the public's fear of being infected with the virus,government departments have gradually implemented measures to disclose information about people involved in the epidemic in various parts of the country,and have also achieved better results in mass prevention and control.It is justified to disclose the information of the people involved in epidemic disease,which comes from the theoretical support,practical needs and social approval.However,the prevention and control of major epidemics should not give priority to public security at the expense of citizens'privacy protection.It is still necessary to follow the three dimensions of necessity,legality and effectiveness of the standard of legitimacy to ensure that the information disclosure of people involved in the epidemic conforms to the provisions of the Constitution and laws and can be controlled in a minimum range.In order to prevent the excessive disclosure of the information of epidemic related personnel,we must face up to the deficiencies of government information disclosure and personal information protection system,optimize the legislative regulation,administrative regulation and judicial regulation,and promote the balance between public security guarantee and personal information protection.
