摘要
治理是在政治国家与市民社会互动的基础上,以调和利益冲突、建立共同认知、采取一致行动为目的的社会协同行为,仲裁是在当事人意思自治的基础上以法院以外的民间力量解决纠纷的替代性方法,二者之间具有理念上的契合性。支持仲裁融入社会治理,有助于在尊重民意的基础上调和矛盾、化解分歧,实现社会秩序的稳定。不过,我国立法对于仲裁的范围作了设定,可仲裁事项的范围较窄,导致仲裁在社会治理中能够发挥作用的空间受到限制。为了充分挖掘仲裁的潜力,使其更好地服务于社会治理,有必要适当拓宽可仲裁事项的范围,明确仲裁机构的非营利法人属性,针对虚假仲裁构建有效的防范机制,从而铸造仲裁公信力。
Governance is based on the interaction of the political state and civil society,whose aim is to mediate conflicts,to establish common cognition,and to act in concert for the purpose of social coordination.Arbitration is on the basis of party autonomy in folk strength,which is deemed as one of the alternative way to solve disputes outside of court.Governance and arbitration have the conceptual compatibility.Supporting the incorporation of arbitration into social governance will help to resolve conflicts and resolve divergences on the basis of respecting public opinion,and to achieve social order stability.However,China’s legislation has set requirements on the scope of arbitration,and the scope of arbitrable matters is relatively narrow,resulting in the limited space for arbitration to play a role in social governance.In order to fully tap the potential of arbitration and to make it better serve social governance,it is necessary to appropriately broaden the scope of arbitrable matters,and clarify the non-profit legal person nature of arbitration institutions,and construct effective prevention mechanism against false arbitration,so as to cast the credibility of arbitration.
