摘要
在婚内财产协议分割的场合,物权变动的生效要件直接决定了在未完成物权公示的情况下,基于协议受让财产的夫妻一方可得到何种程度的保护,以及可以对抗何种类型的第三人。这背后是婚姻保护与民事主体间的交往安全两方价值之间的权衡,两者此消彼长,难以完全兼容。在民法典的既有价值立场之下,基于婚姻保护理念对夫妻一方未公示财产权的保护,应以法定财产制下的一方潜在份额为限。对此,若采公示对抗主义或非基于法律行为的物权变动规则,将使得作为债务人的夫妻一方“不离婚”也能“真逃债”,过分侵蚀交往安全。相较之下,以公示生效主义配合法定财产制的财产权属推定效力,能够更好地平衡婚姻保护与交往安全;采公示生效主义对婚姻保护看似略有不周,但可通过规则的解释和完善有效解决。
In the case of marital property division by agreement,the effective requirements of real right cahnge directly determine the degree of protection that one of the couple receiving property based on the agreement can get,and the type of third party that they can fight against when the real right publication is not completed.Behind this is the balance between the value of marriage protection and the value of security in civil relationships,which are not fully compatible.Under the standpoint of the Civil Code,the protection of unpublicized property rights of one spouse based on the concept of marriage protection should be limited to the potential share of one spouse under the legal property system.In this regard,if the public antagonism or the rules of real right change based on non-legal act is adopted,it will make the couple escape the debt without divorce,and excessively endangers security in civil relationships.In contrast,the validity of publicity combined with the presumption of property ownership in the legal property system can better balance marriage protection and security in civil relationships.The adoption of the doctrine of public validity seems to be a little inadequate for the protection of marriage,but its essence is far less than the appearance,and it can be effectively solved by the interpretation and improvement of the rules.
