摘要
组织网络吸毒行为认定的根本依据是法律规范,既往规范的历史沿革为审视条款的出台背景提供了参考依据,《全国法院毒品案件审判工作会议纪要》的应运而生为组织网络吸毒行为的类型化认定奠定了规范基础。组织网络吸毒行为的认定存在实践案例判法不一、组织行为界定不清、罪数关系认定不明等问题。在类型化认定的逻辑导向下,诱导型组织网络吸毒行为构成引诱、教唆他人吸毒罪;容留型组织网络吸毒行为在满足“场所”的私密性与可控性特征的情况下构成容留他人吸毒罪;非法利用信息网络罪的适用以目的行为构成犯罪或可归属于《刑法》分则规定的行为类型为前提。组织网络吸毒行为的罪数判定应当综合考量毒品犯罪与网络犯罪,并以“行为个数”和“牵连关系”为判断要点,在对比轻重罪的基础上合理适用处断规则。
The fundamental basis for determining the act of organizing drug abuse through the internet lies in legal norms.The historical evolution of past norms provides a reference basis for examining the background of the promulgation of relevant provisions.The emergence of The Summary of the National Court Work Conference on Drug Cases has laid a normative foundation for the typification determination of organized online drug consumption.The determination of organizing drug abuse through the internet faces issues such as inconsistent judicial determinations in practical cases,unclear delineation of organizational behaviors,and indeterminate concurrence relationships.Under the logical framework of typification determination,inducement-type of organizing drug abuse online constitutes the crime of inducing or instigating others to use drugs.Permissive-type organizing drug use online,under the conditions of satisfying the“location”with characteristics of privacy and controllability,constitutes the crime of providing a shelter for drug users.The application of illegal utilization of information networks is premised on the purposeful behavior constituting a crime or belonging to categories stipulated in The Criminal Law.The determination of the concurrence of offenses related to organized online drug consumption should be comprehensively assessed,taking into account both drug-related and cybercrimes,with a focus on the“number of acts”and“involvement relationships”,and a reasonable application of the sentencing guidelines based on the differentiation between minor and serious offenses.
