摘要
随着积极刑法立法观在我国的确立以及刑事立法正在实现由结果主义向预防主义的转变,将专利权置于法益视角下,对专利侵权行为进行刑法规制符合入罪原则的逻辑证成、适应“三审合一”的体系建构,同时也符合TRIPS协定对于专利侵权行为犯罪化的开放性态度。在《中华人民共和国刑法修正案(十一)》强化知识产权刑法保护的刑事政策背景下,多数非罪化旧论难能经得住质疑和理论检验。自20世纪90年代以来,部分TRIPS协定缔约国相继提高了专利侵权罪法定刑标准。我国刑法的“假冒专利罪”已有与专利保护现状脱节之嫌,宜将其修改为“专利侵权罪”,以期同时涵盖假冒专利和非法实施专利的犯罪行为,并规定为自诉犯罪,在积极的责任要素方面限于故意。
With the establishment of a positive view of criminal law legislation in our country and the ongoing transformation of criminal legislation from consequentialism to preventionism.Putting patent rights in the perspective of legal interests and criminalizing patent infringement is logically justified by the principle of criminalization.The system is adapted to the construction of the“triple trials in one”system,and also in line with the TRIPS’openness to the criminalization of patent infringement.In the context of the criminal policy of the“Amendment(XI)to the Criminal Law of the People’s Republic of China”to strengthen the criminal law protection of intellectual property rights,most of the old arguments for decriminalization hardly stand up to challenge and theoretical scrutiny.Since the 1990s,some of the TRIPS member states have successively increased the statutory penalties for patent infringement offences.Globally,the protection of intellectual property is increasingly globalized and standardized.The offence of patent counterfeiting in our criminal law is already out of step with the current state of patent protection,and it is advisable to amend it to“patent infringement”,in order to cover both the offences of counterfeiting and unlawful enforcement of patents,and to provide for a self-incrimination offence,limited to intent in terms of the positive element of liability.
