摘要
经济刑法保护的法益属超个人法益,但无论是个人利益说还是传统秩序说都无助于解决法益理论在立法与司法实践中面临的捉襟见肘的尴尬处境。应当对作为经济刑法法益的超个人法益进行二元化展开,划分为溯源性超个人法益和独立性超个人法益,构建"溯源性+独立性"的经济刑法二元"双环"法益结构。经济刑法以溯源性超个人法益为原则,以独立性超个人法益为例外。溯源性超个人法益与个人法益之间可追溯,用以规制刑法解释,独立性超个人法益限于重大的、基础性经济秩序,用以实现立法批判。
The legal interest protected by the economic criminal law are supra-individual legal interest, but neither the personal interest theory nor the traditional order theory helps to solve the awkward situation that the legal interest theory faces in the legislation and judicial practice. The supra-individual legal interest, which are the legal interest of economic criminal law, should be dualized and divided into traceable supra-individual legal interest and independent supra-individual legal interest, and construct a dual "double loop" legal interest structure of economic criminal law that is "traceable + independent". Economic criminal law is based on the principle of traceable supra-individual legal interest, with the exception of independent supra-individual legal interest. The traceable supra-individual legal interest can be traced to the individual legal interest, which can regulate the interpretation of criminal law. The independent supra-individual legal interest is limited to the major, basic economic order for the purpose of legislative criticism.
