网络空间中“以假充真”型销售伪劣产品罪的认定

摘要 随着交易场所的网络化,网络空间中"以假充真"型销售伪劣产品罪的认定趋于复杂。为兼顾平台经济发展与刑法妥当适用,应着重考察公共法益的可还原性、案件事实的可转化性、产品的伪劣性及刑法的谦抑性。要认定销售伪劣产品罪,销售行为须具有一定的欺诈性:产品不具备基本使用性能,实际侵犯了消费者的合法权益。同时,案件事实可转化为构成要件事实,且不违背刑法谦抑性。 With the networking of trading venues, the determination of the crime of selling fake and shoddy products tends to be complicated. For ensuring the development of platform economy and the proper application of criminal law, we should focus on the reducibility of public legal interests, the convertibility of case facts, the fakery of products and the modesty of criminal law. To determine the crime of selling counterfeit and inferior products, the sales behavior must be fraudulent. That is, the product does not have basic performance and actually violates the legitimate rights and interests of consumers. At the same time, the case facts can be transformed into constitutive facts, and the application of the criminal law does not violate its modesty.
