摘要
2020年的新冠肺炎疫情,凸显了我国突发公共卫生事件中法治社会建设的严重不足。法律规范中社会主体具体义务设定的严重不足,克减公民权利的主体及其情形随意,权利义务一致性教育的不足,惩罚手段的疲软等是其主要原因。应通过健全公共卫生法律规范体系,使得各法律规范之间有效衔接,同时注意各规范自身设定的科学性,加大对突发公共卫生事件中各种违法行为的惩处力度,加快公共卫生事业中公共法律服务建设,加快建立健全政府与社会良性互动的社会协同共治体制等具体举措,来推进我国突发公共卫生事件中法治社会的建设,并以此促进我国法治社会建设的进程。
The Corona Virus pandemic in 2020 highlights the serious shortage in construction of the society rule of law in China’s public health emergencies.In the legal norms,the main reasons are the serious deficiency of the specific obligations of the social subjects,the arbitrary subjects and situations of the civil rights derogation,the deficiency of the consistency education of rights and obligations,and the weakness of the punishment means.By improving the system of public health legislations and regulations,we can effectively link up the laws and regulations,pay attention to the scientific of each regulation,increase the punishment of various illegal acts in public health emergencies,accelerate the establishment of public legal services in public health,and accelerate the establishment and improvement of the social cooperative governance system of benign interaction between the government and society to promote the construction of the society rule of law in public health emergencies,and to promote the process of the construction of the rule of law society in China.
