摘要
在抗击新冠肺炎疫情中,我国依法战“疫”所体现的法治精神是国家治理能力和治理体系现代化的重要表征。其法治观蕴含着法律至上、以人为本、系统思维的理念,和“战“疫””即为法治大考的观念,并通过及时科学立法、严格执法和公正司法,地方积极应急立法和全民守法等方式得以践行。这种具有中国特色的战“疫”法治模式,是多元主体合作实现共赢的结果,是坚持党的领导、人民当家作主和依法治国的有机统一,其中的战“疫”经验为法治体系的进一步完善提供了着眼点。
In the fight against COVID-19,the spirit of rule of law embodied in China's law-based fight against COVID-19 is an important symbol of the country's governance capacity and the modernization of its governance sys⁃tem.This rule of law view implies the idea of supremacy of law,people-orientation and systematic thinking,and the idea that fighting the pandemic is a test of the rule of law,which are practiced through timely and scientific legisla⁃tion,strict law enforcement and fair justice,local emergency legislation and law-abiding by the whole people and other ways.This model of rule of law with Chinese characteristics is the result of win-win cooperation among diverse entities,and the organic unity of upholding the party's leadership of the people as masters of the country and govern⁃ing the country by law.And the experiences of fighting against the pandemic provides a starting point for further im⁃proving the rule of law system.
