摘要
为促进矿产资源充分利用,落实生态文明建设要求,通过具体案例,分析当前矿业权按照矿种出让的弊端和存在的问题,提出"全矿"概念和"全矿"出让课题。同时指出当前推行"全矿"出让将遇到的障碍和问题,并从观念、法律、制度等方面论证其可行性。最终指出矿业权"全矿"出让优于当前按照矿种出让。实施"全矿"出让,真正做到资源充分利用,利于国家、社会、矿山企业和群众,利于生态环境保护。
In order to promote the full utilization of mineral resources and implement the requirements of ecological civilization construction,through specific cases,this paper analyzes the disadvantages and existing problems of the current mining right transfer according to the types of minerals,and puts forward the concept of"whole mine"and the subject of"whole mine"transfer.At the same time,it points out the obstacles and problems that will be encountered in the current implementation of"whole mine"transfer,and demonstrates its feasibility from the aspects of concept,law,system,etc.Finally,it is concluded that the"whole mine"transfer of mining rights is better than the current transfer according to the mineral types.The implementation of the"whole mine"transfer is conducive to the full utilization of resources,the state,society,mining enterprises and the masses,and the protection of the ecological environment.
