摘要
“净采矿权”出让有利于采矿权资产价值实现,维护国家资源所有权益,有利于维护矿业开发良好秩序,有利于实现“多规合一”,促进矿业可持续发展。“净采矿权”出让实施步骤包括联合踏勘、设置条件审查、调查确权、政策处理、公示、告知政策处理实施。现实中“净采矿权”政策处理程度有待深化,政策处理范围应更加具体,政策处理费用标准应予明确。完善“净采矿权”出让制度的建议:(1)探索建立“净采矿权”储备制度;(2)进一步细化政策处理范围;(3)完善政策处理费用标准。
The transfer of"net mining rights"is conducive to realize the asset value of mining right,and protect the rights and interests of national resources,also,it is facilitated to maintain good order in the mining exploration,moreover,it is favorable to the implementation of"multi-plan integration"and the promotion of sustainable development of mining industry.The implementation steps of the transfer of"net mining rights"include joint exploration,setting conditions review,right confirmation through investigation,policy processing,policy publicity and informing the policy processing and implementation.In reality,there is a need for deepening the degree of the policy processing of"net mining rights",besides,the scope of the policy processing should be more specific,and the standard of the policy processing expenses should be clarified.Finally,this paper proposes suggestions on perfecting the system of transferring"net mining rights":(1)exploring and establishing the reserve system of"net mining rights";(2)further refining the scope of policy processing;(3)perfecting the standard of policy processing expenses.
