摘要
经济性裁员是企业自主管理的重要措施之一,为防止企业滥用裁员权利,减少区域性失业人数增加而给社会带来的负面冲击,在劳动合同法倾斜保护立法思想下,优先留用条款是维护劳动者权益的最后一道阀门。但司法实践中,由于优先留用条款存在诸多不适之处,应当重新检视优先留用条款立法价值取向,在此基础之上确定优先留用行为正当性评价准则,并且针对优先留用条款的立法技术、适用情形以及法律后果等方面提出完善意见。
Adopting Economic layoff is one of the important measures of enterprise self-management.In order to prevent the abuse of layoff rights and reduce the negative impact on the society caused by the increase of regional unemployment,the priority retention clause is the last valve to protect the rights and interests of workers under the idea of priority protection of labor contract law.However,in judicial practice,because there are many inadequacies in priority retention clause,the legislative value orientation of priority retention clause should be re-examined,the criterion of evaluating the legitimacy of priority retention behavior should be determined on the basis of it and suggestions for improvement should be put forward on legislative technology,application and legal consequences of priority retention clause.
