摘要
在住房租赁中多数承租人处于弱势地位,其权益最容易受到侵害,最常见的侵害是租期短终止随意、租金贵加租频繁。而承租人的居住权属于基本人权,其居住利益高于财产利益。有必要从法律上对承租人给予倾斜保护,依法赋予承租人特别权利:续租权、涨租抗辩权,让承租人通过稳定、可负担的租赁方式满足基本居住需求。
Most of the tenants are the disadvantaged positions in housing leasing,and their rights and interests are most vulnerable to infringement.The most common infringement is the short termination of the lease period at will,and the frequent increase of rent.The tenant's right of residence belongs to the basic human rights,and its residence interests are higher than property interests.It is necessary to give preferential protection to the lessee from the legal point of view and give the lessee special rights according to law:the right to renew the lease,the right to defend the increase of the lease,so that the lessee can meet the basic living needs through a stable and affordable lease.
