摘要
剖析司法认知规避现象的根源并进行制度激励，在当前民事审判实践中极具现实意义。从司法压力机制、司法指引机制、司法替代机制等角度着手，司法认知规避的深层次根源得以发现。从司法认知规则重构、司法认知案例库体系建设和司法认知责任及其豁免三大方面建构司法认知激励制度，颇具必要性与可行性。关于司法认知规则重构，应坚持简约主义立场，使得司法认知规则简约、明确并具有可操作性；关于司法认知案例库建设，应建立一套从指导性案例到精品案件的多层次案例库体系，建立案例库反馈机制和动态调整机制；关于司法认知责任及其豁免，坚持不当行为作为法官惩戒的主要事由，错案惩戒需要结合客观结果与主观状态来分析，并建立影响性后果错案的豁免制度。
It is of great practical significance in the present civil trial practice to analyze the root of the phenomenon of judicial cognition evasion and carry out institutional incentives. From the angle of judicial pressure mechanism, judicial guidance mechanism and judicial substitution mechanism, the deep roots of judicial cognitive evasion can be found. It is necessary and feasible to construct the judicial cognitive incen- tive system from three aspects of the reconstruction of judicial cognition rules, the construction of judicial cognition case library system and the judicial cognition responsibility and exemption. On the reconstruction of judicial cognition rules, it is encouraged to stick to the minimalist standpoint and make the judicial cogni- tion rules simple, clear and operable. On the construction of judicial cognition case library, it is necessary to establish a multi -level case library system from guiding cases to classic cases, and establish feedback mechanism and dynamic adjustment mechanism of case library. As to responsibility and exemption of judicial cognition, adhere to the improper behavior as the main reason of the judge disciplinary, the wrong cases need to be analyzed combined with objective results and subjective status, and establish the exemption system of misjudged cases with adverse consequences.
