摘要
环境行政执法与刑事司法如何无缝衔接,是时下环境法学界聚讼纷纭的议题。国内学界对此问题的研究大致分为两个阶段:2006年至2012年的"零星研究"阶段与2013年至今的"密集研究"阶段。既有研究的内容主要包括环境行政执法与刑事司法衔接难的归因、衔接程序的冲突及调适、衔接中的监督制约机制、衔接机制的宏观构建等方面,主要存在的问题为基础理论研究薄弱、实证研究不足、微观研究缺失。未来研究应立足于既有理论与实证反思,并对环境行政执法与刑事司法衔接实践中凸显的移案程序繁杂、证据转换困难、检察监督乏力等问题展开深入细致探究。
How to connect the environmental administrative law enforcement and criminal justice is a hot topic in the research of environmental law in China.The research of the academic circles on this issue can be divided into two stages in domestic circles：the ＂sporadic research＂stage from 2006 to 2012 and the ＂intensive research＂stage from 2013 to the present.The main contents of the research include the attribution of environmental administrative law enforcement and criminal justice,the conflict and adjustment of the connection procedure,the supervision and control in the convergence,the concrete construction of the convergence mechanism,and the main problems are the weak theoretical and theoretical research Lack of research,lack of microscopic research.Future research should be based on the existing theory and empirical rethink profoundly,focus on the basic theory of environmental administrative law enforcement and criminal justice convergence,lay emphasis on theoretical and empirical docking,and carry out in-depth research on the complex procedures,poor evidence convergence,weak procuratorial supervision in practice.
