摘要
我国商事仲裁存在案件分流不突出,效率不高和收费不合理等方面的问题,原因在于三个方面:首先是仲裁机构行政色彩较浓,影响了仲裁的独立性;其次是仲裁缺乏市场竞争力,解决纠纷的公信力不高,由于仲裁靠国家行政拨款就可生活,没有市场竞争和开拓意识,由此导致对纠纷解决专业性和权威性都不够;再次是司法对仲裁支持不够,导致仲裁分流纠纷乏力。这表现为三个方面:一是司法理念更新不够;二是法院不愿意推广仲裁纠纷解决模式;三是在进行司法审查时,法院始终较为强势。破解仲裁分流难的问题,必须促进仲裁机构早日民间化,建立调裁对接机制,完善仲裁管辖,要强化司法与仲裁的深度融合与监督,建立法院附设仲裁的纠纷分流模式,加强仲裁机构对案件的管理工作。
There are some problems in China's commercial arbitration such as the case division is not prominent, the efficiency is not high and the charge is unreasonable. The reason lies in three aspects: the first is the administrative color of the arbitration body is strong, which affects the independence of arbitration. The second is the arbitration is lack of market competitiveness, and the credibility of the dispute resolving is not high. Because the arbitration can live by the state administrative funding which has no market competition and development consciousness, which caused the professionality and authority of dispute resolution are not enough.The third is the judicial support for arbitration is not enough, which causes the arbitration of the dispute is weak. It is expressed in three aspects: the first is the judicial idea update is not enough. The second is the court is reluctant to promote arbitration dispute resolution mode. The third is in the judicial review, the court has always been more powerful. To crack difficult problems of the arbitration shunt, it is necessary to promote the arbitration institution early popularization, establish the mechanism of cutting and regulating, improve the arbitration jurisdiction, strengthen the depth of integration and supervision of judicature and arbitration, establish the court annexed arbitration of disputes split mode, and strengthen the case management of the arbitration organization.
