摘要
商事仲裁与民事诉讼分流衔接机制的构建对建立多元解纷机制、促进我国法治社会建设和社会主义市场经济的发展十分重要。拟立足辽宁省仲诉分流衔接实际,采用问卷调查与访谈相结合的实证研究方法,探究商事仲裁与民事诉讼存在的“诉讼爆炸”、仲诉分流衔接机制形同虚设的现实困境。产生困境的主要原因在于人民法院的“门户之见”,“重司法轻仲裁”的思想较为普遍;商事仲裁机构行政色彩较浓厚,缺乏主动参与仲诉分流衔接机制构建的意愿;当事人对商事仲裁了解不够,缺乏主动用其解决纠纷的动力。解决辽宁省仲诉分流衔接机制困境的关键在于完善人民法院的立案登记制度,必然要求推动仲裁机构“去行政化”改革,重点在于提升公众对商事仲裁的知情度。
The construction of the diversion and linkage mechanism between commercial arbitration and civil litigation is very important to the establishment of a diversified dispute resolution mechanism and the promotion of the construction of a rule-of-law society and the development of a socialist market economy in China.Based on the actual practice of arbitration and civil litigation in Liaoning Province,the empirical research method of questionnaire survey and interview is used to investigate the “litigation explosion” of commercial arbitration and civil litigation,and the real dilemma of the diversion mechanism of arbitration and civil litigation.The main reasons for the dilemma are that people have a “sectarian bias” toward the court and the idea that “justice is more important than arbitration” is common;commercial arbitration institutions have a strong administrative color and lack the willingness to actively participate in the construction of the arbitration-complaint diversion mechanism;parties do not know enough about commercial arbitration and lack the initiative to use it to solve their problems.The parties do not know enough about commercial arbitration and lack the motivation to use it to solve disputes.The key to solving the dilemma of the arbitration-complaint interface mechanism in Liaoning Province lies in improving the registration system of the court,which inevitably requires promoting the “de-administration” reform of arbitration institutions,with an emphasis on enhancing the public′s knowledge of commercial arbitration.
