摘要
我国仲裁机构主要根据1995年国务院办公厅《重新组建仲裁机构方案》在设立初期由当地政府参照事业单位安排解决,并逐步实现自收自支。按照《仲裁法》要求,仲裁委员会与行政机关没有隶属关系,即仲裁机构不应列入行政事业单位序列,但截至目前仍没有相关法律法规及政策文件就仲裁机构主体资格、如何定性问题予以明确少数民族自治州等没有获得与其他设区的市同等的仲裁机构设置与管理权限。因此,为推进仲裁机构市场化改革任务,需解决仲裁机构的组织形式性质和类别等问题,并同时考虑少数民族自治州等地级市享有同等仲裁机构设置与管理权限。
The establishment of arbitration institutions should apply to 1995"Plan for Reorganization of Arbitration Institutions"of the General Office of the State Council.According to the requirements of the Arbitration Law,the Arbitration Commission has no subordinate relationship with any administrative agency,which means arbitration institutions should not be included in the sequence of administrative institutions.There are no relevant laws,regulations or policy documents that clarified the legal status and nature of arbitration institutions.In practice,arbitration institutions have been threated.with reference to public institutions at the initial stage of establishment,and gradually realized self-financing and self-expenditure.Therefore,to truly realize the task of market-oriented reform of arbitration institutions,it is necessary to clarify legal status of arbitration institutions.
