摘要
在现代社会,生态破坏和环境问题日益突显。而对于环境的治理和环境案件的处理,有必要引入—种人—社会-司法的生态整体主义理念予以规制和救济。借鉴经济学的理性人理论,提出生态理性人的预期评估、价值判断与解决方案。从社会性的环境问题出发,引入社会化形式的整体性、自然性和道德性。从环境司法完善的角度来看,阐述环境司法专门化是中国生态环境司法保障的根本出路。
In the modern society,there were some increasingly highlighted problems about the ecological and en- vironmental destruction. And for the protection of the environment and governance of environmental case, it was nec- essary to introduce a ecological holism concept about human-society-justice. Lessoning from the rational man theory in economics, this paper would draw the ecological rational person with the expected evaluation, value judgment and the proposed solution. From the social environmental problems,it would introduce the socialization involving integrity, na- ture and morality. From the perspective of environmental justice perfect, it would be believed that specialization on environmental justice be the fundamental ways to safeguard ecological environment in judicial in China.
