摘要
《民事诉讼法》和《环境保护法》赋予环保组织提起环境民事公益诉讼的资格后,社会各界对环保组织积极投身实践,以维护环境公共利益怀有很高的期待。然而多年的实践表明,环保组织参与环境民事公益诉讼举步维艰,积极性并不高。导致这种状况的原因多样,环保组织缺乏有效的资金保障是其中的主要原因。要改变这种局面,有必要建立环境公益诉讼基金制度,保障环保组织有能力参与环境民事公益诉讼。设立环境公益诉讼基金的模式主要有政府设立模式和基金会设立模式,在我国选择政府设立模式更为实际、有效。在具体构建环境公益诉讼基金制度时,必须对基金的设立、资金来源、使用范围以及资金监管等问题做出细致规定,保障环境公益诉讼基金合法、有效运转。
After Civil Procedure Law and Environmental Protection Law endowed the environmental protection organization with the qualification of filing environmental civil public interest litigation,all sectors of society have high expectations for environmental protection groups actively to throw themselves into the practice of environmental public interests litigation.However,the years’practice shows that many environmental protection groups have not enough enthusiasm in participating in environmental civil public interest litigation under such a difficult circumstance.There are many reasons for this situation,and the main reason is the lack of effective financial guarantee of environmental protection groups.To change this situation,it is necessary to establish the fund system of environmental public interest litigation to guarantee the environmental protection groups to be able to participate in it.The main modes of establishing the fund are the government establishment mode and the foundation establishment mode.It is more practical and effective to choose the government establishment mode in China.Once the fund system of environmental public interest litigation is established,it is necessary to make strict regulations on the fund establishment,fund source,scope of using the fund and supervision of the fund so as to guarantee the legal and effective working of environmental public interest litigation fund.
