摘要
风险社会、复杂性理论同环境危机之间存在关联性,而公共行政的后现代转向则与环境多元治理相契合,并促发环境多元治理模式的生成。行政契约是环境多元治理模式的法理基石。环境多元治理模式有赖于多元参与、协同合作以及整体开放这些价值目标的实现。为此,要大力培育社会组织来确保治理的多元性;用行政契约来规范权利和义务,以保障治理的协同性;构建交互式、回应型的信息交流平台,以实现治理方式的整体开放性。
While the environmental crisis is related to the risk society and the complexity theory,the postmodern turn of public administration agrees with the multi-level environmental governance,and promotes the formation of multi-level environmental governance mode. The administrative contract is the legal foundation of multi-level environmental governance mode. This mode depends on the achievement of the values of pluralistic participation,collaborative cooperation and holistic openness. Therefore,the social organizations are supposed to be fostered to ensure the diversity of governance,the right and obligation should be regulated by the administrative contract to secure the collaboration of governance,and the information communication platform with the interaction and feedback should also be built to realize the holistic openness of the governance mode.
