摘要
体育标准是一个包含着技术法规、强制性标准和推荐性标准的混合体。从发展趋势看,体育标准正朝向自愿性的本原发展。标准是软法的重要表现形式,在软法理论指导下,体育标准治理的内在动力机制包括动力机制、开放机制、市场机制等,外在作用方式则显示了具有实际作用效果与约束力的特点。体育标准治理具有法治意义,它能够降低法治成本、传达实质法治精神,进而推进体育法治建设目标的实现。
Sport standard is a mixture containing technical regulations, mandatory standards and recom- mended standard. From the development trend, sports standard is towards voluntary origin development. Standard is an important type of soft law, under the direction of soft law theory, inherent motive mecha- nism of sports standard management includes impetus system, opening system, and marketing system, etc. external function shows the features of practical effects and binding characteristics. Standard for sports management has legal significance,and it can reduce the cost of rule of law, convey the essence of the spirit of the rule of law and promote the construction of sport legal system to achieve the goal.
