摘要
部门法哲学是世界法学研究的前沿和最有前景的跨学科的交叉研究领域,作为对现有研究的概括和命名,部门法哲学的提出是当代中国法学的一个理论创新。所谓的部门法哲学,其实是对这一领域的刑法哲学、民法哲学、行政法哲学、诉讼与司法哲学、宪法哲学、经济法哲学、商法哲学、国际法哲学等所有部门法学与法哲学之间跨学科研究的一个总称。部门法哲学区别于部门法学的标志在于反思的视角及其问题设定的方式。部门法哲学与法哲学的区别在于其研究的是法律的局部而非整体,并且形成了自身的范畴体系。部门法哲学的范畴一般是法哲学范畴的下位概念。
Philosophy in Branches of Law is the frontier and a promising inter - disciplinary study field in world legal study. As a wrap - up and definition of existing studies, it is a theoretical innovation in contemporary legal science of China. It is a general term of inter - disciplinary studies between branches of law and legal philosophy, such as philosophy of criminal law, philosophy of civil law, philosophy of administrative law, philosophy of judiciary, philosophy of constitutional law, philosophy of economic law,. philosophy of commer- cial law, and philosophy of international law. Its division with branches of law lies in the perspective of reflection and the method of designing problems. Its division with legal philosophy lies in the scope of study as part instead of whole, and forms its own system of categories which are generally substitute concepts of legal philosophy.
