摘要
法理学与部门法学在基础知识领域的互通交融印证了经济法法理学命题的正当性和合法性。部门法哲理化思潮的涌现与经济法的时代转型为开展经济法法理学研究奠定了坚实的理论基础和现实基础。建构经济法法理学体系,首先需要探寻经济法部门的存在基础。在具体的研究实践中,则需要以调整对象问题的探索为视点,着力从经济法的法律关系理论出发,以"主体—行为—责任"范式框架为基本路径,完成经济法的部门法理学建构。考察经济法之存在基础与经济法法理学命题之间的内在关联可以看出,未来的经济法法理学研究,正在由宏大叙事向微观论证转变,由追求体系独特性向探索哲理化之路靠拢。
The blending of jurisprudence and department law in the field of basic knowledge has reflected the legitimacy of jurisprudence proposition of economic law. The emergence＇of philosophical trend of depart- ment law and the era transition of economic law laid a solid theoretical foundation and realistic foundation for the development of jurisprudence research of economic law. To frame the jurisprudence system of economic law, we first need to find the existence of economic law department ; in specific research practice, putting the regulating object as the target, focusing on the legal relationship theory of economic law, with the ＂subject-behavior-responsibility＂ paradigm as the basic path to complete the framing of the departmental jurisprudence of economic law. It can be seen from the research of the inner relation between the foundation of the existence of economic law and the jurisprudence proposition of economic law that the jurisprudence research of economic law in the future is shifting from the grand narrative to microscopic argument, and from the pursuit of uniqueness system to exploration of a philosophical approach.
