摘要
中立的帮助行为是指具有中立性的帮助行为,其不同于一般的帮助行为。对于中立的帮助行为在共犯教义学中存在全面处罚说与限制处罚说之分,基于中立帮助行为具有的业务性、专业性等中立特征,应当采取限制处罚说。根据限制处罚说,只有对那些客观上可归责,并且主观上具有犯意沟通的帮助行为才能进行处罚,由此限缩帮助犯的处罚范围。中立的帮助行为可以分为销售型、服务型、技术型、义务型等类型,这些中立帮助行为的不同类型在确定是否具有刑事可罚性上应当区别对待。
Neutral helping act refers to the neutrality of helping behavior and is different from ordinary helping acts.For neutral helping act,there is a distinction between the theory of comprehensive punishment and the theory of restricted punishment in the doctrine of complicity.Based on the neutral characteristics such as business and professionalism of neutral helping behavior,the theory of restrictive punishment shall be adopted.According to the theory of restricted punishment,only those helping acts that are objectively attributable and subjectively communicative can be punished,which narrows the scope of punishment for helpers.Neutral helping act can be divided into sales type,service type,technical type,obligation type,etc.,and the different types of these neutral helping acts should be treated differently when determining whether they are criminally punishable.
