摘要
生态文明建设是关系中华民族永续发展的大计,而推进生态文明建设要求全面、系统、科学的法治保障。环境法法典化正是应映了这一社会历史发展的法治要求,环境法法典化也自然而然成为环境法学的研究热点话题。梳理环境法法典化研究成果,论证了环境法法典化应该秉持的立场:立足于人与自然和谐共生的基本理念和定位于可持续发展的目标价值;论述了环境法法典化包含的内容:“生态环境”基石概念的界定和环境法治体系的建立。环境法法典化的理论与实践探索过程,需要智力支持与人才加持的合力,这也才能为环境法典编纂注入充足动力,助力编纂出我国第一部“绿色法典”。
The construction of ecological civilization is a major project related to the sustainable development of the Chinese nation, and promoting the construction of ecological civilization requires comprehensive, systematic and scientific legal protection. The codification of environmental law reflects the rule of law requirement of this social and historical development, and the codification of environmental law has naturally become a hot topic in environmental law research. Combing the research results of environmental law codification, this paper demonstrates the position that environmental law codification should uphold: based on the basic concept of harmonious coexistence between man and nature and the target value of sustainable development. This paper discusses the contents of codification of environmental law: the definition of the cornerstone concept of “ecological environment” and the establishment of environmental legal system. The theoretical and practical exploration process of environmental law codification needs the joint efforts of intellectual support and talent blessing, which can also inject sufficient power into the compilation of environmental law and help compile the first “green code” in China.
