摘要
当前民法典制定过程中的两个侵权行为法草案对雇佣人赔偿责任规定的差异表明目前我国学界对此问题仍然存在较大分歧。在归责原则上,由于无过错归责符合现代社会公平及风险分散理念,已成为国际立法趋势,因此我国应当采取无过错归责原则。在一些如受雇人范围、主观心理状态等细节问题也仍未形成统一认识,并且,当前的讨论中还忽略了一个非常重要的诉讼时效问题,需要进一步探讨。
There are many employing relations in our society,which cause series problems that employee raise injure on the others during the working.With the reform of tort law and establishment of liability without fault,it is the common tendency to admit the employer's obligation to pay compensation.But there are some deficiency and vacancies in the existing tort law of China in this respect.In order to perfect our tort law and its application,we should deepen the academic discussion.
