摘要
传统上复议、诉讼等对行政权的监督,过于强调个案和局部,而在系统性、全局性维护行政法律秩序方面有所忽视,亟需行政检察进行补位。行政检察制度虽进展明显,但其理论体系和制度设计尚存在薄弱环节。其监督范畴涵盖全部行政活动和行政诉讼。依申请而启动的监督救济,须遵循补充性原则;依职权而启动的检察监督,须遵循谦抑性原则;两类监督原则上不受期限限制。其基础功能是,通过对行政法律实施活动进行检察调查、抗诉、建议等,构建、维护和恢复良好法律秩序,以及对当事人进行权利救济等。
Although the development of administrative procuratorial supervision has made remarkable progress,its theoretical framework and institutional design still present weaknesses.The scope of administrative procuratorial supervision encompasses all administrative activities and administrative proceedings.Supervisory relief initiated upon application shall follow the principle of complementarity,while procuratorial supervision initiated ex officio shall follow the principle of modesty and restraint.In principle,neither form of supervision is subject to time limits.The primary function of administrative procuratorial supervision is to conduct investigations,file protests,offer recommendations,and provide rights relief to restore and maintain a sound legal order through the inspection of administrative law enforcement activities.
