摘要
新时代行政检察具有化解行政争议、促进行政争议案结事了的重要功能。这一功能的确定,既标志着多元化解决行政争议制度的形成,也是行政检察积极履行法律监督职能、解决实践中因行政诉讼“程序空转”而难以实质性解决行政争议等问题的现实需要。在行政检察过程中化解行政争议符合行政诉讼制度要求与现实需要。行政检察应立足于中央要求与《行政诉讼法》的立法宗旨,从法律监督的主体地位角度,针对行政诉讼中阻碍行政争议化解的突出问题而展开。继续推进“穿透式”检察监督,强化对行政诉讼立案程序的监督,并以《民法典》和新《行政处罚法》为依据开展行政争议的化解工作,提升检察机关在行政检察过程中实质性化解行政争议的能力与效率。
The administrative procuratorialwork in the new era has the important function of resolving administrative disputes and promoting"administrative case concluded with matter resolved".The determination of this function means the formation of a diversified system forresolving administrative disputesand the practical needs of actively performing the function of legal supervision by the administrative procuratorial work to solve the problem that it is difficult for the administrative litigation to substantially resolve administrative disputes due to the theidleness ofproceedings in practice.Resolving administrative disputes in the process of the administrative procuratorialwork is in line with the requirements of the administrative litigation system and practical needs.Administrative procuratorialwork should be based on the requirements of the central government and the legislative purposes of the Administrative Procedure Law,carried out from the perspective of the status as the subject of legal supervision,and targeting at prominent problems that hinder the resolution of administrative disputes in administrative litigation.It is necessary to continue the promotion of the"penetrating-style"prosecutorialsupervision,strengthen the supervisionover the case filing procedure of the administrative litigation,and carry out the resolution of administrative disputes according to the Civil Code and the new Administrative Punishment Law,andenhance the ability and efficiency of procuratorial organs to substantially solveadministrative disputes in the process of administrative procuratorialwork.
