摘要
程序倒流具有查清案件事实,保障刑事追诉正确的作用。这种功能定位造成诉讼拖延、超期羁押、权利侵犯等负面后果。立法者意识到了程序倒流的危害,在历次司法改革中逐步限制其适用次数、适用事由以及法律后果。这种限制单一一项程序倒流措施适用的改革模式取得一定成效。但是,由于单项限制模式无法进行整体限制,程序倒流的负面后果无法根除。通过比较发现,整体限制程序倒流的前提是建立诉讼进程调控机制。目前,我国案件质量评价指标已经具备一定的调控诉讼进程的功能,但其属于一种宏观调控,因而不能规范具体案件办理,无法保证个案中的程序倒流得到限制。未来,需要建立整体的、系统的刑事诉讼进程调控机制,确立刑事诉讼程序不可逆机制及其例外情形、保障措施,整体限制程序倒流。
The measure of procedural reversals plays a role in finding out the facts and ensuring the correctness of criminal prosecution.This functional positioning leads to negative consequences such as litigation delay,prolonged detention,and infringement of rights.Legislators have realized the harm of procedural reversals and gradually restricted its application frequency,reasons for application,and legal consequences in various judicial reforms.The reform model that restricts the application of a single procedural reversal measure has achieved certain results.However,because the single restriction mode cannot impose overall restriction,the negative consequences of procedural reversals cannot be eradicated.Through comparison,it is found that the prerequisite for overall restriction of procedural reversals is to establish a mechanism for regulating the litigation process.At present,China's case quality evaluation index has a certain function of regulating the litigation process,but as it is a macroeconomic regulation,it cannot standardize the handling of specific cases,and therefore cannot guarantee the restriction of procedural reversals in individual cases.In the future,we need to establish a comprehensive and systematic mechanism for regulating the criminal litigation process and establish a mechanism of irreversibility of litigation process and its exceptions,safeguard measures,and overall restrict procedural reversals.
