摘要
补充侦查是依照法定程序,在原有侦查工作的基础上进一步查清事实、补充完善证据的诉讼活动,是刑事诉讼法上的一项重要制度。补充侦查制度适用于刑事诉讼的多个节点,在不同诉讼阶段中,补充侦查的内容不尽相同,随着国家监察体制改革和刑事诉讼法的修改,补充侦查制度的格局有所变化。补充侦查制度具有重要的价值功能,是检察权能的一个重要载体,为实现侦查活动的目的提供了必要保障。《关于加强和规范补充侦查工作的指导意见》细化了相关规定,提出了一些重要的制度创新,对于提高补充侦查质效、规范补充侦查制度运行有着重要意义。在未来,应当落实司法改革的要求,结合具体实践需要,对补充侦查制度作出进一步完善。
Supplementary investigation is a litigation activity in which the facts are furthered investigated to supplement and perfect the evidence based on the original investigation in accordance with the legal procedures.It is an important system of criminal litigation.The supplementary investigation system is applicable to multiple nodes in criminal proceedings.The contents of supplementary investigations vary with the stages of the proceedings.Along with the reform of the national supervision system and the revision of China’s Criminal Procedure Law,the structure of the supplementary investigation system has changed.Of particular note is that this system has important value functions,is an important carrier of the procuratorial power,and provides the necessary guarantee for the realization of the purpose of investigation activities.The Guiding Opinions on Strengthening and Regulating Supplementary Investigation have specified the relevant regulations and proposed some important institutional innovations,which are of great significance for improving the quality and efficiency of supplementary investigations and standardizing the operation of the supplementary investigation system.In the future,the requirements of judicial reform should be implemented and according to the specific practical needs,the supplementary investigation system should be further improved.
