摘要
义愤杀人案件因其情与法、人伦孝义与犯罪事实的复杂交织而频频引发社会关注。当前司法实务中对义愤杀人犯罪存在认定标准不一、义愤情节易被忽视、量刑畸轻畸重甚至同案不同判等问题。定罪方面,引起义愤杀人的“不义”行为应严格限定为严重悖德行为,只有“不义”行为的实施对象及与实施对象有特殊关系者才能够被认定为义愤杀人者,为终结长期迫害的“非当场性”杀人行为也可以被认定为义愤杀人。量刑方面,应当将“义愤”动机(原因)作为确定义愤杀人犯罪量刑起点的基本犯罪构成事实,以普通故意杀人罪的量刑规范确定基准刑,并综合案件实际,依据犯罪行为的社会危害程度和犯罪人的人身危险程度,谨慎、严格地把控义愤杀人犯罪中量刑情节的调节幅度。
Murders in righteous indignation have frequently aroused social concerns because of complex interweaving of emotion and law,human filial piety and criminal facts.In current judicial practice of this kind of crime,there are problems,such as that the standard of recognition varies,the circumstances of righteous indignation is easy to be ignored,and the sentencing is whether too light or too heavy,or even different sentences appear for the same case.In terms of conviction,the“unrighteous”act of killing in righteous indignation should be strictly limited to a serious act of immorality,and only the person who have experienced it firsthand and has a special relationship with the person who have experienced it firsthand can be recognized as the person who killed in righteous indignation.And the“off-the-spot”killings aiming to end the long-term persecution can also be considered as righteous killings.In terms of sentencing,the“righteous indignation”motive(reason)should be taken as the basic constitutive fact to determine the starting point of sentencing for the crime of righteous indignation murder,and the base sentence should be determined according to the sentencing norms of ordinary intentional homicide.And the adjustment range should be cautiously and strictly controlled according to the actual circumstances and the degree of social harm of the crime and the degree of personal danger of the perpetrator.
