摘要
法律翻译作为一种跨文化交际活动,是法律文化融合与交流过程中的重要枢纽。由于中西方文化差异较大,在法律翻译中可能无法准确翻译法律术语,这就给法律翻译带来了挑战,同时也影响了其翻译质量。如果能够从中英法律文化差异的角度展开深入分析,找到准确切入口,势必可以为法律术语的翻译提供助力。因此,该文从中西法律文化差异入手,了解了法律术语翻译的“五个维度”,进而提出了掌握西方法律的目的术语及渊源术语、寻找功能对等的法律术语完成翻译、促进法学与英语教育的融合、强化法律翻译人员的语言素养等策略来进行法律术语的精准翻译,以期为法律翻译人员提供参考与借鉴。
As a cross-cultural communication activity,legal translation is an important hub in the process of legal cultural integration and communication.Due to the large differences between Chinese and Western cultures,it may not be possible to accurately translate legal terms in legal translation,which brings challenges to legal translation and also affects its translation quality.If we can analyze the differences between Chinese and English legal cultures in depth and find an accurate entry point,it will certainly help the translation of legal terms.Therefore,starting from the differences between Chinese and Western legal cultures,this paper understands the"five dimensions"of legal term translation,and then puts forward the strategies of mastering the purpose terminology and origin terminology of the Western laws,searching for the functional equivalence of legal terms to complete the translation,promoting the fusion of law and English education,and strengthening the linguistic literacy of the legal translators in order to carry out the accurate translation of legal terms in the hope of providing references for the legal translators.
