论电商刷单炒信行为治理路径——以电商平台为视角 被引量:3

摘要 针对治理机制较为完善但依然猖獗的刷单炒信行为,以电商平台商品权重机制的销量—评价导向以及平台—商家决策的成本收益逻辑为框架分析刷单炒信行为成因。对比剖析平台处理规则以及法律法规,指出存在法律规制作用范围不定、处罚严厉但层级相对集中、平台规则介入见效及时但处罚不力等问题。进而提出以平台基础治理为主,发挥政策法规支撑作用,构建完善消费信誉机制的多元主体治理模式。 In the face of rampant frauds of click farm for good credit hyping which even though are cracked down well,this research firstly analyzes the causes of such frauds within the frame of sale-assessment orientation of weight mechanism for goods on e-platforms and platform-merchant decision logic for costs and profits;secondly,by contrastively analyzing platform rules and legal regulations,finds such problems as the uncertain legal regulation scope,severe but relatively centralized level of punishment,inadequate penalties even though with timely effect for platform rule intervention;and lastly,proposes a multiple-subject treatment model mainly with basic treatment by platforms,supported by policies and regulations and having a mature consuming credit mechanism.
