摘要
网络空间作为犯罪场域滋生了以帮助信息网络犯罪活动罪为代表的妨害信息网络公共秩序的犯罪,这类网络空间犯罪所保护的法益是信息网络公共秩序。网络虽然具有虚拟性,但与现实空间需要维护公共秩序一样,网络空间也存在公共秩序价值。信息网络公共秩序法益具有相对于现实空间公共秩序法益的独立性,不应以扰乱现实空间中的公共秩序作为认定行为构成妨害信息网络公共秩序犯罪的标准。《刑法修正案(九)》将一些具有预备、未遂、帮助性质的行为规定为独立的犯罪,这类妨害信息网络公共秩序犯罪是对于现实空间公共秩序法益的前置化保护。为了防止公共秩序法益的不当扩张对个人法益造成损害,应当明确妨害信息网络公共秩序犯罪的认定标准,界定信息网络公共秩序法益的保护范围。
As a crime field,cyberspace has spawned crimes that disrupt the public order of information networks,represented by the crime of helping information network criminal activities.The legal interest protected by such cyberspace crimes is the public order of information networks.Although the network is virtual,the value of public order also exists in cyberspace just as the real space needs to maintain the public order.The legal interest of public order in the information network is independent of the legal interest of public order in the real space,and disturbing the public order in the real space should not be used as a criterion to determine that an act constitutes a crime of disturbing the public order of the information network.Amendment(IX)to the Criminal Law of the People's Republic of China defines some acts with preparatory,attempted and helpful natures as independent crimes,and this kind of crime that impacts the public order of information network is the pre-protection of legal interests of public order in the real space.In order to prevent the improper expansion of legal interests in the public order from harming the individual legal interests,it is necessary to clarify the identification standards of crimes against the public order of information network and define the protection scope of the legal interests of the public order in the information network.
