摘要
构建总体国家安全法治格局是一个循序渐进的过程,需要以总体国家安全观为指导,并辅以完善的国家安全立法体系、执行体系、司法体系、监察体系,如此才能真正实现在法治轨道上维护国家安全。国家安全法治保障具有多元化特点,人民法院作为宪制性机构在国家法治保障中可以发挥独特作用。积极参与国家安全治理既是人民法院及司法人员的法定职责,也是推进国家安全法治化的重要途径。因此,人民法院需要通过全面转变国家安全司法观念、提升维护国家安全的司法能力、继续完善内部管理工作制度等手段,弥补其贯彻国家安全法治理论的疏漏之处。
The establishment of an overall national security rule of law pattern is a gradual process,which needs to be guided by an overall national security concept and supplemented by a sound national security legislation system,enforcement system,judicial system and supervision system.Only in this way can national security be truly safeguarded on the basis of the rule of law.The legal protection of national security is characterized by diversification.As a constitutional institution,the People's Courts can play a unique role in the legal protection of the country.Active participation in national security governance is not only the legal duty of the People's Courts and judicial personnel,but also an important way to promote the rule of law of national security.To this end,the People's Courts need to make up for the omissions in the implementation of the rule of law theory of national security by comprehensively transforming the judicial concept of national security,enhancing the judicial ability to safeguard national security,continuing to improve the internal management system and other means.
