摘要
危害国家安全类案件裁判文书极少公开,通过裁判文书分析国家安全司法实践状况容易失真,从法院工作报告观察国家安全司法实践情况是可行的替代方法。分析近年法院工作报告发现,总体国家安全观法治化在司法领域尚未全面落实,国家安全司法理念也未实现全面转变,危害国家安全典型案件及司法数据公开效果不佳。为提升国家安全司法效能,需继续转变国家安全司法理念,加强国家安全司法指引,推动国家安全司法公开。
Judgment documents of cases endangering national security are rarely disclosed,and it is easily distorted to analyze judicial practice of national security through judgment documents.Instead court work reports are a feasible alternative to observe the judicial practice of national security.The analysis of court work reports in recent years revealed that the legalization of overall national security outlook has not been fully implemented in the judicial field,the concept of national security justice has nor been fully transformed,and the publicity effect of typical cases endangering national security and judicial data has been poor.To promote the efficiency of national security justice,we need to continue to change the concept of national security and justice,strengthen the guidance of national security and justice,and propel the openness of national security and justice.
