摘要
数字社会是用数字技术来表达、交流、储存、分析使用信息,进而展开一系列活动的社会。在这一新兴社会形态中,诉讼法虽未面临颠覆性、根本性的挑战,但也必然发生重要变革,一种不同于传统诉讼法的数字诉讼法正应运而生。互联网法院(法庭)、在线诉讼、区块链证据等带有数字因素的新型诉讼制度与诉讼机制便是数字诉讼法的典型标识。在数字技术发展与诉讼数据“喂养”之下,数字诉讼法有着广阔的生长空间,但同时也受到了传统诉讼法一般原则与机理的约束,且面临着数字技术水平、社会接受度等制约。继续探索在原则、机理等重要方面不同于传统诉讼法的数字诉讼法,正视数字技术在诉讼法变革中的有限性,合理研发数字诉讼的技术产品并通过试点验证,将有助于推动数字诉讼法的良善发展。
Digital society is a society that uses digital technology to express,communicate,store,analyze and use information,and then develop a series of activities.In this emerging social form,although the procedural law does not face subversive nor fundamental challenges,it is bound to undergo important changes,and a digital procedural law different from the traditional procedural law is emerging as the times require.New systems with digital factors such as Internet courts(tribunal),online litigation,and blockchain evidence are typical signs of digital procedural law.Under the development of digital technology and the “feeding” of data,digital procedural law has a broad space for growth,but at the same time it is constrained by the general principles and mechanisms of traditional procedural law,and it faces constraints such as digital technology level and social acceptance.Continue to explore digital procedural law that is different from traditional procedural law in important aspects such as principles and mechanisms,face up to the important role of digital technology in the reform of procedural law,and rationally develop digital products and pass pilot verification,will help promote good development of the digital procedural law.
