摘要
人工智能元年标志着人工智能技术的崛起与发展,法学界反应尤为激烈,甚至产生"法律死亡"的论断。从人类历史发展和经济转型的角度透视其本质,理性地得出人工智能是技术革命的阶段之一。但是,人工智能和法学在话语体系、应变性和价值方面的冲突将伴随人工智能发展的全过程。通过对当前法学在应对过程中表现的态度、研究现状和研究方式展开批判性分析,指出法学博弈过程中的"胜利之道",形成人工智能重塑法学,法学走向新发展的共生局面。
The scholars of law field over-reacted to the rise and development of artificial intelligence technology,thinking that artificial intelligence would lead to the death of law.From the perspective of human history development and economic transformation,it can be concluded rationally that artificial intelligence is one of the stages of technological revolution.However,the conflict,between artificial intelligence and science of law in discourse system,adaptability and value,will remain in the whole process of artificial intelligence development.Through a critical analysis of the attitude,research status and methods of the current science of law in the process of coping with it,this paper points out the"winning way"of law in the game process,and forms a co-existence situation in which artificial intelligence reshapes jurisprudence and jurisprudence moves towards new development.
