摘要
通过对环境公益诉讼案件生态环境修复执行机制的现状考察,本文梳理了司法实践中存在重制裁轻修复的司法理念偏差,判决不规范欠明确难执行、修复费用监管主体乱、修复执行问效差等问题;继而对环境公益诉讼案件生态环境修复执行的应然发展方向进行理论探讨和“江西模式”的实践经验考量后,分析得出司法理念应从实然的制裁为主转向应然的环境修复为主的结论,并据此提出了规范环境公益诉讼案件涉生态环境修复判决执行标准、建立以治理为中心的“多元共执”生态环境修复执行机制、设立统一的生态环境司法修复资金管理机构的具体建议。
Through the analysis of the status quo of the execution mechanism for ecological environment restoration in environmental public interest litigation cases across China,this paper explains several issues in judicial proceedings,such as the deviation of the judicial philosophy of emphasizing sanctions over environment restoration,the difficulty of enforcement caused by casual judgments,the disordered supervision of environment restoration and the poor efficiency of environment restoration implementation.After theoretical discussion on the development direction of the implementation of ecological environment restoration in environmental public interest litigation cases and practical experience of the "Jiangxi Model," this paper analyzes and concludes that the judicial concept should shift from actual sanctions to environment restoration.It then puts forward specific suggestions for standardizing the execution standards of ecological environment restoration judgments in environmental public interest litigation cases,establishing a governancecentered "pluralistic and multi-party execution" ecological environment restoration mechanism,and establishing a unified ecological environment judicial restoration fund management organization.
