摘要
警察街头行政执法在特定的场域中展开,执法结果与场域中资本、权力与惯习等因素有着紧密关联。实践中,警察、执法对象、围观群众及其所拥有的资本、权力与惯习共同形成了执法场域。执法过程中,在维持执法场域和谐竞争中,不同主体迫于种种压力和利益最大化所做出收敛和妥协。利用场域中的资本、权力与惯习通过非正式权力运作、执法选择策略等方式保持执法任务完成,但存在治标不治本、弱化警察执法权威等风险。从场域理论出发,优化警察街头执法环境,提升执法效能应从三个方面出发,一是促进场域中资本培育与合理化配置,充分发挥资本效能;二是完善场域权力结构,加强国家权力和社会权力的互动;三是培育良好的惯习系统,引导行动者合理合法行为。
Police administrative law enforcement in street is carried out in a specific field,and the results of law enforcement are closely related to the capital,power and habits in the field.In practice,the police,law enforcement targets,onlookers,and their capital,power and habits together form the law enforcement field.In the process of law enforcement,when maintaining harmonious competition in the law enforcement field,different subjects are forced by various pressures and maximization of interests to make convergence and compromise.Using the capital,power and habits in the field to maintain the completion of law enforcement tasks through informal power operation and law enforcement selection strategies,there are risks such as treating the symptoms but not the root cause and weakening the law enforcement authority of the police.Starting from the field theory,optimizing the police street law enforcement environment and improving the efficiency of law enforcement should start from three aspects:first,promote the cultivation and rational allocation of capital in the field,and give full play to the capital efficiency;the second is to improve the field power structure and strengthen the interaction between national power and social power;the third is to cultivate a good habitual system and guide the reasonable and lawful behavior of actors.
