摘要
我国新能源汽车动力电池将进入规模化退役阶段,如何处理退役的废旧动力电池成为业界的重要议题。基于欧盟《新电池法》草案,立足交通领域碳中和背景下动力电池的战略需求,从欧盟动力电池回收利用法律制度的视角,总结了欧盟《新电池法》的特点和内容。借鉴欧盟《新电池法》法律制度设计的经验,结合我国动力电池回收相关法律法规尚不完善,碳足迹、回收指标及溯源系统尚不健全等问题,提出加快我国新能源汽车动力电池回收利用的立法进程、完善法律法规制度的顶层设计及建立健全我国新能源汽车动力电池回收的法律制度、政策执行机制的建议。
China′s new energy vehicle power batteries will enter large-scale decommissioning,and how to deal with retired waste power batteries has become an important issue in the industry.Based on the draft of EUNew Battery Law,and the strategic needs of power batteries under the background of carbon neutrality in the field of transportation,from the perspective of the EU power battery recycling legal system,the characteristics and contents of EUNew Battery Laware summarized.By referring to the experience of the legal system design of EUNew Battery Law,combining with the problems of the imperfect laws and regulations,the unsound carbon footprint,recycling index and source system in China,the study puts forward suggestions for accelerating the legislative process,improving the top-level design of laws and regulations for power battery recycling,establishing and improving the legal system and policy implementation mechanism for the recycling of new energy vehicle power batteries in China.
