摘要
由于疫情防控背景下外国人入境活动相关的法律规范内容较少,我国出入境边防检查机关作为外防输入重要主体,在应对重大疫情背景下传染病输入国内的问题时,仍然面临着一定的困境。面对法律规范自身存在的问题,需要完善法律规范内容,增强约束力,协调不同法律规范之间的衔接,才能构建法律规范之间逻辑性的闭环,疏通法治症结,有效应对重大传染病输入我国境内,确保国家安全、人民健康及发展利益得以维护。
Due to the lack of laws and regulations related to the entry of foreigners in the context of epidemic prevention and control,China’s exit and entry border inspection authorities,as an important body of foreign import prevention,still face certain difficulties when dealing with the import of infectious diseases in the context of major epidemics. Facing the problems existing in the legal norm itself,need to perfect the content of legal norms, strengthen the binding force,coordination between different legal norms of cohesion,to build a logical loop between legal norms,dredge the crux of rule of law,effective response to major infectious disease to enter the territory of China,ensure national security,interests to maintain people’s health and development.
